Universe TCG Preorder Policy: Allocations, Market Risk, Sealed Products, Returns and Refund Conditions
This Preorder Policy applies specifically to all products purchased from Universe TCG under preorder, reservation, backorder, future release, allocation-based sale, restock reservation, limited release, second wave, reprint reservation or any similar advance-purchase modality.
This policy is not a general stock-sale policy. It is designed specifically for preorders, especially high-demand Trading Card Game (“TCG”) products, sealed collectible products, allocation products and items whose supply depends on manufacturers, distributors, suppliers, release schedules and final allocation.
By placing a preorder with Universe TCG, the customer expressly acknowledges and accepts that preorder products are not guaranteed stock and may be affected by limited production, distributor allocation, reduced supply, shipment waves, manufacturer delays, release-date changes, cancelled supply, restock uncertainty and other circumstances outside Universe TCG’s direct control.
A preorder is not a guarantee of supply, not a guarantee of quantity, not a guarantee of allocation and not a guarantee of delivery by a specific date, unless Universe TCG expressly confirms otherwise in writing after final distributor allocation has been received.
Preorder products, especially TCG products, may be highly volatile in market value. The customer accepts that a preorder is a binding advance-purchase commitment and may not be used as a speculative instrument where the customer keeps the product if the market price increases but attempts to cancel or return the product if the market price decreases.
Important preorder notice: This is a binding preorder product. Supply, quantity and delivery date are not guaranteed and depend on distributor allocation. Customer cancellation is not available before delivery due to delay, change of mind, price decrease, loss of market demand, negative market reception, product overavailability or third-party pricing. TCG preorder products are volatile collectible goods and the customer accepts this market risk when placing the preorder. After delivery, any legally applicable return or withdrawal request is subject to return, receipt and inspection. Opened, unsealed, manipulated, damaged or depreciated sealed products may have a refund value of €0.00 where legally permitted. Return shipping is paid by the customer.
1. What is a preorder?
A preorder is an advance purchase or reservation of a product that is not yet available for immediate dispatch at the time of purchase. Preorders may relate to future releases, limited-run products, allocation products, restocks, second waves, reprints or products expected to arrive through official distribution channels.
When placing a preorder, the customer requests that Universe TCG attempts to obtain the product through its professional suppliers, distributors or manufacturers. Final fulfilment depends on the stock actually received by Universe TCG and on the final allocation granted by distributors, suppliers or manufacturers.
2. Preorder does not mean confirmed stock
A preorder must not be understood as confirmed physical stock already held by Universe TCG. Unless the product page expressly states that the item is in stock and ready for immediate dispatch, the product remains subject to allocation, availability, arrival and supplier confirmation.
The customer understands that preorder products are supplied only if Universe TCG receives sufficient stock from its distributors or suppliers. A preorder confirmation, payment confirmation or order confirmation does not mean that the product has already been allocated to that customer.
3. TCG products, high demand and allocation risk
TCG products are frequently subject to extraordinary demand, limited print runs, manufacturer restrictions, distributor allocations, delayed shipment waves and reduced supply. This is particularly common with booster boxes, sealed displays, collector boxes, elite trainer boxes, bundles, starter decks, special collections, promotional products, limited editions and sealed accessories.
The customer expressly acknowledges that, in the TCG market, the quantity ordered or requested from a distributor by a store may not be the quantity finally supplied to that store. Universe TCG may request or reserve a quantity from its suppliers and later receive a much lower allocation, a split allocation, a delayed allocation or no allocation at all.
By placing a preorder, the customer accepts that high-demand TCG products may be delayed, reduced, partially fulfilled or fully cancelled depending on the final allocation received by Universe TCG.
4. No guarantee of supply, quantity or delivery date
Unless expressly confirmed in writing by Universe TCG after final distributor allocation has been received, a preorder does not guarantee:
- that the product will be supplied;
- that the full quantity ordered will be supplied;
- that more than one unit will be supplied;
- that any unit will be supplied if allocation is insufficient;
- that the product will be dispatched on the official release date;
- that the manufacturer’s estimated release date will be maintained;
- that the product will be restocked after the first allocation;
- that public demand, distributor availability and customer orders will match.
Any date shown on the website, product page, invoice, order confirmation, email or public announcement must be understood as an estimated date only, unless Universe TCG expressly identifies it in writing as a guaranteed delivery date.
5. Fulfilment priority and order date
Where stock is limited, Universe TCG will generally process preorder fulfilment according to the following criteria:
- date and time of the customer’s preorder;
- payment confirmation;
- quantity actually received by Universe TCG;
- distributor allocation rules;
- product-specific limitations;
- fair distribution among customers where necessary;
- operational, logistical, payment-security or fraud-prevention requirements.
Earlier preorders will generally have priority over later preorders. However, Universe TCG may apply fair-allocation rules when supply is extremely limited, especially where full fulfilment of large multiple-unit preorders would prevent other customers from receiving any product.
Order priority does not create an unconditional right to receive the product if Universe TCG does not receive enough allocation from its suppliers.
6. Multiple-unit preorders may be reduced to one unit or zero
Customers who preorder more than one unit of the same preorder product expressly acknowledge that, in the case of limited allocation, Universe TCG may reduce the quantity supplied.
Depending on final allocation, customer demand and order priority, a preorder may be:
- fulfilled in full;
- fulfilled partially;
- reduced to one unit per customer;
- reduced to a lower quantity than ordered;
- reduced to zero units if allocation is insufficient;
- cancelled in full if Universe TCG receives no viable supply.
Where a customer preorders multiple units, the customer accepts that there is a significant possibility that the preorder may be reduced to the minimum available quantity or, where no allocation can be assigned to that preorder, to zero units.
7. Distributor allocations and final confirmation
Final preorder fulfilment depends on the allocation communicated by Universe TCG’s distributors, suppliers or manufacturers. Until Universe TCG receives express confirmation of the final allocation, any preorder remains subject to change.
Distributor allocation may be communicated close to release date, after release date or in several separate shipment waves. Universe TCG cannot guarantee that allocation information will be available immediately after the customer places the preorder.
Once Universe TCG has express knowledge of a distributor allocation issue affecting the customer’s preorder, Universe TCG will take reasonable steps to inform the customer and offer the corresponding options, which may include partial fulfilment, cancellation by Universe TCG, refund for non-supplied items or keeping the preorder open for a possible future restock.
8. Preorder deadlines and closed preorder windows
Some preorder products may be subject to reservation windows, manufacturer cut-off dates, distributor closing dates or internal preorder deadlines.
Once a preorder window is closed, Universe TCG may no longer be able to add, modify, increase or guarantee any further units. Orders placed after a deadline, or orders for products already marked as closed, sold out, allocation pending or unavailable, are not guaranteed and may be cancelled or left pending only if Universe TCG considers that a realistic supply opportunity remains.
9. Preorder payment and contractual commitment
Payment for a preorder confirms the customer’s intention to purchase the product under the preorder conditions stated in this policy. Once the preorder is placed, Universe TCG may commit the corresponding quantity request to its suppliers, distributors or internal allocation records.
Preorders may involve operational and commercial commitments by Universe TCG with third parties. For this reason, customer cancellation requests may be limited once the preorder has been processed, submitted to a supplier, allocated internally or linked to a distributor commitment.
This does not affect any mandatory consumer rights that cannot be waived under applicable Spanish or European Union law.
10. No customer cancellation of preorder before delivery
A preorder is a binding advance-purchase commitment made by the customer under the specific preorder conditions stated in this policy. Once a preorder has been placed and processed by Universe TCG, the customer may not cancel the preorder simply because the product has not yet been released, has not yet arrived, has been delayed, has changed in market value or is still pending distributor allocation.
Preorder cancellation before delivery is not available at the customer’s unilateral request, unless Universe TCG expressly accepts the cancellation in writing, the preorder has not yet been processed, or mandatory consumer law provides otherwise.
The customer understands that Universe TCG may rely on the preorder to make supplier commitments, distributor reservations, allocation requests, payment allocations and internal stock-planning decisions. For this reason, preorder cancellation is restricted once the preorder has been placed.
The customer may not cancel a preorder before delivery due to:
- manufacturer delay;
- distributor delay;
- release-date change;
- allocation uncertainty;
- market price increase;
- market price decrease;
- loss of hype or reduced public interest;
- negative market reception;
- the customer no longer considering the product desirable;
- third-party listings at a different price;
- secondary market speculation;
- change of mind before delivery;
- the customer no longer wanting the product.
If Universe TCG cannot supply the preorder due to lack of allocation, cancelled supply, distributor failure, manufacturer cancellation, product discontinuation or any other supply issue outside Universe TCG’s control, Universe TCG may cancel the affected preorder fully or partially and refund the amount paid for the non-supplied product.
11. Preorder market risk and no speculative cancellation
The customer expressly acknowledges that TCG preorder products are highly volatile collectible goods. Their market value may increase or decrease significantly before release, after release, during allocation periods or after delivery. This volatility is part of the nature of preorder TCG products and is fully accepted by the customer when placing the preorder.
A preorder placed with Universe TCG is a binding advance-purchase commitment. The customer may not cancel a preorder before delivery because the product has decreased in market value, because public interest in the collection has changed, because the customer no longer considers the product desirable, because the customer believes the collection is underperforming, or because the same or similar product is later listed elsewhere at a lower price.
The customer understands and accepts that Universe TCG is not providing a free market-risk option. A preorder cannot be used by the customer as a speculative instrument where the customer keeps the product if the market price rises but attempts to cancel, return or shift the loss to Universe TCG if the market price falls.
For clarity: if a customer preorders a product for €300 and the market value later rises to €500, Universe TCG does not owe the customer any compensation, price difference, extra value, extra units or market adjustment. Likewise, if a customer preorders a product for €300 and the market price later falls to €120, the customer may not cancel the preorder before delivery or require Universe TCG to absorb the market loss solely because the product has become less valuable, less demanded or less attractive in the secondary market.
By placing a preorder, the customer accepts the commercial risk associated with the product’s market perception, popularity, demand, supply, reprint risk, secondary-market value and post-release performance.
12. No cancellation due to price drops, loss of demand or change of mind
Preorder cancellation is not available because of a price drop, loss of hype, negative market reception, reduced collector demand, product overavailability, third-party discounts, social media opinion, customer regret or change of mind before delivery.
The customer accepts that once a preorder has been placed, Universe TCG may make supplier commitments, allocation requests and internal stock-planning decisions based on that preorder. The customer may not transfer the commercial consequences of a market decrease to Universe TCG by cancelling the preorder before delivery.
Universe TCG’s duty is to attempt to fulfil the preorder as soon as reasonably possible according to allocation, supplier availability and order priority. Universe TCG is not responsible for preserving, guaranteeing or matching the product’s secondary-market value after the preorder is placed.
13. Price fluctuations and market value changes
TCG products may experience significant market price fluctuations before, during and after release. The customer acknowledges that preorder prices may differ from future market prices, restock prices, resale prices, distributor prices or prices offered by third parties.
Once a preorder is placed, subsequent increases or decreases in market value do not automatically modify the original purchase price agreed with Universe TCG.
Universe TCG is not responsible for external market fluctuations, speculative value changes, resale prices, secondary market expectations, third-party listings or changes in the perceived collectability of the product.
A customer may not demand cancellation, compensation, price matching, additional units, replacement value, resale value, market-value compensation or any other adjustment solely because the product’s market price has increased or decreased after the preorder was placed.
14. Release dates, delays and third-party schedule changes
Release dates are established by manufacturers, licensors, distributors or other third parties. Universe TCG does not control product manufacturing, international shipping, customs, distributor logistics, official street dates, reprint timing or release schedule changes.
Any estimated release date or expected arrival date may be modified without prior notice due to circumstances outside Universe TCG’s control.
A delay in the release, arrival, allocation or dispatch of a preorder product does not automatically entitle the customer to compensation, damages, discounts or additional benefits, without prejudice to any mandatory rights that may apply under consumer law.
15. Partial fulfilment, cancellation by Universe TCG and refund options
If Universe TCG receives confirmation that a preorder cannot be supplied in full, Universe TCG may cancel or reduce the affected part of the preorder.
In such cases, Universe TCG may offer the customer one or more of the following options:
- accept the reduced quantity available;
- receive a refund for the non-supplied units;
- accept cancellation of the affected preorder product and receive a refund;
- keep the affected product pending for a possible future restock;
- choose another solution expressly offered by Universe TCG in writing.
If Universe TCG cancels a preorder product due to lack of supply, allocation failure, distributor cancellation, manufacturer cancellation, product discontinuation or any other reason preventing viable fulfilment, Universe TCG’s obligation will generally be limited to refunding the amount actually paid for the cancelled product, except where mandatory law provides otherwise.
16. Option to keep the preorder pending for a possible restock
Where a preorder cannot be fulfilled in the first allocation, Universe TCG may give the customer the option to keep the preorder pending in case a future restock, second wave, reprint or additional allocation becomes available.
Keeping a preorder pending for a possible restock does not guarantee that the product will eventually be supplied. It simply means that the customer chooses to maintain the preorder open while Universe TCG continues to monitor potential availability.
If the customer chooses not to keep the preorder pending after Universe TCG has confirmed a supply failure, Universe TCG will process the applicable refund for the non-supplied product.
17. Withdrawal rights in preorder products
For online purchases made by consumers, statutory withdrawal rights may apply in accordance with applicable Spanish and European Union consumer law. As a general rule, where the right of withdrawal applies, the consumer may have 14 calendar days from the day of delivery to exercise that right.
However, the right of withdrawal is not absolute. Certain preorder products may be excluded from withdrawal rights or may lose return eligibility after delivery due to their nature, condition, seal, hygiene implications, deterioration, expiry, manipulation or total loss of commercial resale value.
This is especially relevant for preorder products that are sealed, collectible, allocation-based, perishable, hygiene-sensitive, limited, market-sensitive or whose value depends on being returned in the exact same condition in which they were delivered.
This policy does not exclude mandatory consumer rights that cannot legally be waived. However, the customer acknowledges that withdrawal, return and refund requests for preorder products will be assessed according to the type of product, applicable legal exceptions and the actual condition of the returned item.
18. Withdrawal after delivery, review process and abuse prevention
Where a statutory withdrawal right applies after delivery under mandatory Spanish or European Union consumer law, any return request will be subject to Universe TCG’s review and inspection process.
The customer must return the product in the exact same condition in which it was delivered, including original factory seal, outer wrap, packaging, accessories, inserts, promotional items, barcodes, labels and collectible condition, where applicable.
Universe TCG may withhold the refund until the returned product has been physically received at its warehouse and inspected. No refund will be finally approved before Universe TCG has verified the condition, completeness, seal, packaging, handling, possible manipulation and commercial resale condition of the returned item.
Universe TCG reserves the right to reject abusive, speculative or bad-faith return patterns where legally permitted, including attempts to use preorder returns as a way to avoid market decreases, transfer secondary-market losses to Universe TCG, or selectively keep products that increase in value while returning products that decrease in value.
Any return that is accepted will be assessed according to applicable law, the actual condition of the product, the product’s commercial resale condition and any loss of value caused by handling, opening, manipulation, damage, deterioration, loss of seal, loss of collectible condition or loss of marketability.
19. Sealed TCG products and collectible condition
Many preorder products sold by Universe TCG are sealed TCG and collectible products. Their commercial value may depend entirely on the integrity of the original factory seal, outer wrap, display box, packaging condition, edition, batch, promotional contents and overall collectible status.
Sealed TCG preorder products include, but are not limited to:
- booster boxes;
- sealed displays;
- collector boxes;
- elite trainer boxes;
- starter decks;
- sealed packs;
- special collections;
- limited editions;
- sealed accessories;
- promotional sealed products;
- any preorder product whose value depends on being factory sealed.
A sealed TCG preorder product returned after being opened, unsealed, tampered with, resealed, damaged, scratched, bent, marked, incomplete, altered or otherwise manipulated is not the same product in the same commercial condition as the product delivered to the customer.
Where a return is legally applicable or expressly accepted by Universe TCG, sealed TCG preorder products must be returned:
- unopened;
- unused;
- unmanipulated;
- with the original factory seal intact;
- with all original packaging and components;
- without signs of tampering, resealing, damage or wear;
- in the exact same condition in which they were delivered.
20. 100% depreciation for opened, unsealed or manipulated products
The customer expressly acknowledges that sealed TCG preorder products and sealed collectible preorder products may lose their entire commercial resale value if they are opened, unsealed, manipulated, tampered with, resealed, damaged, altered or returned in a condition different from the condition in which they were delivered.
Where legally permitted, if a sealed TCG preorder product or sealed collectible preorder product is returned opened, unsealed, manipulated, tampered with, resealed, damaged, incomplete or otherwise altered, Universe TCG may apply a 100% depreciation due to total loss of sealed commercial condition.
In such cases, the refund value of the affected product may be €0.00. This means that no refund will be issued for that product if, after inspection, Universe TCG determines that the item has lost its sealed, new, collectible, hygienic, resale or commercial condition due to the customer’s handling.
This is not a penalty. It is a valuation of the returned product’s real condition and commercial value. A sealed collectible product that is opened or manipulated is no longer equivalent to the sealed product originally delivered.
21. Market value, resale value and refund assessment after delivery
TCG preorder products may increase or decrease significantly in market value before release, after release or during the return period. The customer expressly acknowledges that preorder products are market-sensitive collectible goods and that external prices may fluctuate due to demand, scarcity, reprints, restocks, distributor supply, competitive listings, secondary market speculation or product popularity.
Universe TCG does not owe the customer any compensation, additional units, price adjustment, resale-value payment or market-value difference if the product increases in value after the preorder is placed.
For example, if the customer preorders a product for €300 and the market value later increases to €500, the customer may not claim the €200 difference from Universe TCG. Universe TCG’s obligation is limited to attempting to fulfil the preorder under the agreed preorder conditions, subject to allocation and availability.
If a return or withdrawal is legally applicable after delivery, Universe TCG will assess the returned product based on its actual condition, commercial resale condition, sealed status, packaging integrity, completeness, handling, deterioration, marketability and verifiable resale value at the time the product is inspected by Universe TCG.
Where legally permitted, any loss of value identified during inspection may be deducted from the refund. This may include loss of value caused by opening, unsealing, manipulation, damage, resealing, missing components, loss of factory condition, loss of collectible condition, deterioration, improper storage or any other handling beyond what is legally necessary to establish the nature, characteristics or functioning of the goods.
If the returned product is no longer capable of being resold by Universe TCG as new, sealed, factory-condition, collectible-grade stock, Universe TCG may calculate the refund by reference to the product’s actual resale value in its returned condition, which may be equal to or lower than the current market value for comparable affected, opened, damaged, unsealed or depreciated products.
A market increase will never create an obligation for Universe TCG to refund or compensate above the original amount paid by the customer. A market decrease does not give the customer a right to cancel a preorder before delivery. After delivery, a market decrease may be relevant only where it evidences the real resale value of the specific returned product after inspection, deterioration, loss of sealed condition or other depreciation, and only to the extent permitted by applicable law.
22. Examples of market value and refund treatment
The following examples are provided for clarity:
- Market increase: if the customer preorders a sealed product for €300 and the market value later rises to €500, Universe TCG is not required to compensate the customer for the €200 difference.
- Market decrease before delivery: if the customer preorders a product for €300 and the market value later falls to €120 before delivery, the customer may not cancel the preorder solely because of that price decrease, loss of hype, reduced demand or change of mind.
- Returned sealed and perfect: if a legally valid withdrawal applies and the product is returned unopened, unmanipulated, complete and in the exact same condition as delivered, the refund will be assessed under applicable consumer law.
- Returned opened or manipulated: if the product is opened, unsealed, damaged, resealed, incomplete or manipulated, Universe TCG may apply depreciation. Where legally permitted, such depreciation may reach 100%, resulting in a refund value of €0.00.
- Loss of marketability: if the customer bought a product for €300 and returns it in a condition that can only be resold for €120, Universe TCG may assess the refund based on the real commercial condition and resale value of the returned item, where legally permitted.
- No speculative refund rights: customers may not use preorder returns to speculate on market changes, keep products that rise in value and attempt to cancel or return products that fall in value without regard to preorder commitments, allocation restrictions, product condition or legal return limits.
23. Food, perishable and hygiene-sensitive products
Universe TCG may sell or include food, beverages, snacks, confectionery, promotional edible products or other perishable or hygiene-sensitive goods as part of preorder campaigns, bundles, promotional packs or related product offerings.
Due to their nature, these products may be excluded from withdrawal rights where they are liable to deteriorate, expire rapidly, lose freshness, become unsuitable for resale, present hygiene concerns or cannot be returned in the same condition in which they were delivered.
The customer acknowledges that a perishable item returned days after delivery may no longer be equivalent to the item originally received. For example, a fresh or cream-based food product returned after several days would not have the same condition, freshness, safety, value or resale suitability as when it was delivered.
Returns may be refused for food, edible products, beverages, perishable goods or hygiene-sensitive products where:
- the product has been opened;
- the product has been partially or fully consumed;
- the seal or protective packaging has been broken;
- the product has deteriorated after delivery;
- the product has expired or is close to expiry due to customer delay;
- the product has been stored improperly by the customer;
- the product cannot be safely or hygienically resold;
- the product is no longer in the same condition as delivered.
Where legally permitted, if a food, perishable or hygiene-sensitive preorder product is returned in a condition that prevents resale, safe handling or verification of integrity, Universe TCG may reject the return or apply up to 100% depreciation, resulting in a refund value of €0.00 for the affected item.
24. Return shipping paid by the customer
Where a return is legally applicable or expressly accepted by Universe TCG, the customer is responsible for the direct cost of returning the product to Universe TCG’s warehouse, unless mandatory law provides otherwise.
The customer must make the initial payment for return shipping and must ensure that the product is returned with adequate packaging, tracking and insurance where appropriate.
If Universe TCG offers a return shipping label or arranges return transport as a convenience, the cost of that service may be deducted from the total refund amount, unless Universe TCG expressly states otherwise in writing or mandatory law provides otherwise.
The customer remains responsible for the product until it is physically received by Universe TCG’s warehouse. Any loss, damage, deterioration, missing contents or manipulation occurring during return transport may affect the refund assessment.
25. Refund only after return, receipt and inspection
Where a withdrawal, return or refund is legally applicable or expressly accepted by Universe TCG, the refund will not be finally approved until the returned product has been physically received by Universe TCG and inspected.
The customer must return the product in perfect condition, complete, protected, unopened where applicable and in the same condition in which it was delivered.
Universe TCG may withhold the refund until:
- the product has been physically received at Universe TCG’s warehouse;
- the item has been inspected;
- the condition of the product has been verified;
- all components, packaging, accessories, seals and inserts have been checked;
- any depreciation, damage, opening, tampering, missing item or hygiene issue has been assessed;
- the applicable return shipping cost, if any, has been calculated.
If the returned product is not in the same condition as delivered, Universe TCG may deduct the loss of value from the refund or reject the return where legally permitted.
If the product has been opened, unsealed, manipulated, tampered with, damaged, altered or has lost its sealed commercial condition, Universe TCG may apply 100% depreciation, resulting in a refund value of €0.00 for the affected product, where legally permitted.
Refunds, where approved, will normally be issued to the original payment method, unless another lawful method is expressly agreed with the customer.
26. Customer obligations in preorder purchases
By placing a preorder, the customer agrees to:
- read and accept this preorder policy before completing the purchase;
- understand that preorder products may not be supplied in full;
- understand that TCG preorder products may be subject to allocation, reduction or cancellation;
- understand that TCG preorder products may increase or decrease in market value;
- accept that market decreases do not create a cancellation right before delivery;
- accept that Universe TCG is not a free market-risk option or speculation tool;
- provide accurate contact, billing and shipping information;
- keep contact details updated while the preorder remains pending;
- review Universe TCG communications regarding allocations, delays, reductions, refunds or restock options;
- respond within a reasonable timeframe when Universe TCG requests a decision;
- return any approved return at the customer’s own cost unless otherwise required by law;
- make the initial payment for return shipping where a return is requested by the customer;
- return any approved product in perfect condition and with adequate protection;
- not open, damage, manipulate or alter products that must remain sealed to preserve their value;
- accept that opened, unsealed or manipulated sealed products may have a refund value of €0.00 where legally permitted;
- not base a preorder on speculative resale expectations or guaranteed market value assumptions.
27. Limitation of liability
To the maximum extent permitted by applicable law, Universe TCG shall not be liable for losses, claims, damages, inconvenience, resale losses, speculative losses, lost profits, missed opportunities, market-price changes, collection-completion expectations or third-party price differences arising from:
- manufacturer delays;
- distributor allocations;
- insufficient stock supplied to Universe TCG;
- release-date changes;
- product discontinuation;
- limited print runs;
- logistics delays;
- customs delays;
- market price fluctuations;
- secondary market speculation;
- customer expectations regarding resale value;
- third-party announcements, listings or availability claims;

If Universe TCG cannot supply a preorder product due to allocation, lack of availability or supplier failure, Universe TCG’s responsibility will generally be limited to refunding the amount paid for the affected product, without prejudice to any mandatory rights that may apply under Spanish or European Union law.
Nothing in this policy excludes liability where such exclusion is prohibited by law, including liability for intentional misconduct, fraud, personal injury caused by negligence or non-waivable consumer rights.
28. Force majeure and third-party events
Universe TCG will not be responsible for failure or delay in fulfilling a preorder where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to manufacturer delays, supplier cancellations, distributor allocation cuts, transport disruptions, customs issues, strikes, natural disasters, war, regulatory restrictions, licensing issues, production shortages, payment processor disruptions, platform failures or any other event outside Universe TCG’s direct control.
In such cases, Universe TCG may extend the estimated fulfilment period, offer partial fulfilment, offer a refund for the affected product, keep the preorder pending for possible restock or cancel the affected product where supply is no longer viable.
29. Applicable legal framework
This preorder policy is governed by the laws applicable in Spain and, where relevant, by European Union consumer protection rules. It must be interpreted together with Universe TCG’s General Terms and Conditions, Return Policy, Privacy Policy and any product-specific conditions displayed before checkout.
In particular, this policy is intended to be interpreted consistently with:
- Spanish consumer protection law, including the consolidated General Law for the Defence of Consumers and Users;
- European Union consumer rights rules for distance contracts;
- Spanish e-commerce and information society services rules;
- mandatory consumer rights that cannot be waived by contract.
If any clause of this policy is found to be invalid, unlawful or unenforceable, the remaining clauses will remain in force to the maximum extent permitted by law.

Does placing a preorder guarantee that I will receive the product?
No. A preorder does not guarantee supply. TCG products may be subject to distributor allocation, manufacturer delays and limited availability. If Universe TCG cannot supply the product, the customer will be informed and the applicable refund or restock option will be offered.
If I preorder several units, will I receive all of them?
Not necessarily. Multiple-unit preorders may be reduced depending on final allocation. In high-demand releases, preorders may be reduced to one unit, a lower quantity or zero units if allocation is insufficient.
Can Universe TCG reduce my preorder to zero units?
Yes. If final allocation is insufficient or no viable supply is received, Universe TCG may reduce the affected preorder to zero units and offer the applicable refund or restock option.
Can I cancel a preorder before delivery?
Customer cancellation before delivery is not available at the customer’s unilateral request, unless Universe TCG expressly accepts it in writing, the preorder has not yet been processed, or mandatory law provides otherwise.
Can I cancel a preorder because the market price dropped?
No. A price drop, loss of hype, negative market reception, reduced demand, third-party discount or change of mind does not give the customer a right to cancel the preorder before delivery.
What happens if the preorder product increases in value?
If the product increases in market value, Universe TCG does not owe the customer any compensation, price difference, extra units or market-value adjustment. The agreed preorder price remains the applicable price.
What happens if the preorder product decreases in value?
If the product decreases in market value before delivery, the customer may not cancel the preorder solely because of that decrease. The customer accepts the market risk associated with TCG preorder products when placing the preorder.
Can I withdraw from a preorder after delivery?
Where legally applicable, statutory withdrawal rights may exist after delivery. However, preorder products must be returned in the same condition in which they were delivered, and some products may be excluded or subject to depreciation due to their nature, seal, hygiene, perishability or condition.
Can I return an opened sealed TCG preorder product?
If a sealed TCG preorder product has been opened, unsealed, manipulated, damaged, resealed or altered, it may lose its sealed commercial condition. Where legally permitted, Universe TCG may apply 100% depreciation, resulting in a refund value of €0.00.
Why can an opened sealed product have a refund value of €0.00?
Because a sealed collectible product that has been opened or manipulated is no longer equivalent to the sealed product originally delivered. Its sealed commercial and collectible value may be completely lost.
Can I return food or perishable preorder products?
Food, edible products, beverages and perishable goods may be excluded from withdrawal rights where they can deteriorate, expire rapidly, present hygiene concerns or cannot be returned in the same condition as delivered.
Who pays the return shipping costs?
Unless Universe TCG expressly states otherwise or mandatory law provides otherwise, the customer is responsible for the direct cost of returning the goods. If Universe TCG provides a return label as a convenience, the cost may be deducted from the total refund.
When will I receive my refund after returning a preorder product?
Where a refund is approved, Universe TCG may withhold the refund until the product has been physically received, inspected and verified. Any loss of value, opening, manipulation, damage or return shipping cost may be deducted where legally permitted.
